In the International Court of Justice (ICJ), hearings on the «Advisory Opinion on the Legal Consequences of Israel’s practices in the Occupied Palestinian Territories» continue. On the third day of the hearings held at the Peace Palace in The Hague, Netherlands, Jasmine Moussa, legal advisor to the Egyptian Ministry of Foreign Affairs, presented her country’s arguments.

Asserting that the Middle East craves peace and stability, Moussa said that a comprehensive and permanent solution to the Palestinian-Israeli conflict could be achieved with the establishment of a Palestinian state on the pre-1967 borders with East Jerusalem as its capital. Asserting that the current violations of international law are part of a broader policy aimed at taking Palestinian land, Moussa emphasized that the occupation as a whole has become illegal.

Asserting that Palestine has been subjected to the longest occupation in modern history, Moussa said: «It is shocking that some states do not want the court to express its legal opinion. What message does this send about their respect for international justice and the rule of law?» Also, stating that the court serves as an additional and fundamental element in upholding the role of the UN General Assembly, Moussa said, «This is critically important, considering that there is no real hope for a peaceful solution.»

‘INDEFINITE OCCUPATION VIOLATES PALESTINE’S RIGHT TO DETERMINE ITS POLITICAL STATUS’

Asserting that there is very strong evidence that Israel intends to permanently change the demographic structure of the occupied Palestinian lands and expand its sovereignty over these lands, Moussa said: «This includes Israel’s massive coercion of Palestinians in Gaza through illegal evacuation orders and indiscriminate use of force.» «It is accompanied by displacement,» she said. Asserting that international courts accepted the 1967 occupation as an act of aggression, not of self-defense, Moussa said, «The right to self-determination is the fundamental principle of international law. All states have a duty to respect and protect this right. Indefinite occupation means that Palestinians’ policy «violates the rights of people to determine their status and to continue their economic, social, and cultural development,» she stated.

«How long must the Palestinian people wait to benefit from their legitimate rights under international law?» Moussa said, adding: «History will judge us based on our reaction today.» In calling on the court to decide that Israel must pay compensation and immediately end its occupation and illegal practices, including settlements, Moussa said: «Prosperity, security, stability, and peace cannot be achieved in the Middle East without justice and the rule of law.»

‘WHAT HAPPENS BEFORE EVERYONE’S EYES CONFIRMS GENOCIDE’

Diplomat Anayansi Rodríguez Camejo, who made a verbal statement on behalf of Cuba, asserted in her statement that Israel and its allies, who violate international law, must assume legal responsibility for their actions. «The situation happening before everyone’s eyes confirms the ongoing genocide,» Camejo said, adding: «We believe that the court should not wait for the complete destruction of an entire nation to decide on the matter.»
